When an individual asks to establish a health savings account (HSA), must the custodian/trustee ask for proof that the individual is covered by a high-deductible health plan?
No. IRS Notice 2004-2, Q&A-10 indicates that an HSA custodian/trustee may require proof or certification that the individual is indeed covered by a high-deductible health plan but there is no requirement to do so.
